Terms and Conditions

GENERAL INFORMATION

1. TCO Online Shop operating at www.shop.tco.com.pl, is run by TCO. Trading Company Sp. z o.o. with its registered office in: Biznes Park 1, 83-200 Linowiec, entered into the National Court Register under the KRS number: 0001022876. NIP: number 592-040-03-73 Regon number: 190050022.

2. To make purchases, you don’t have to register in the store’s system. If you create an account, it will  be protected by a  password. The ordering party is obliged to provide your address, contact telephone number and e-mail address to confirm the order.

3. By registering or logging in the Customer agrees to the use of personal data provided in the registration form. The transfer of data takes place on the basis of art. 23 sec. 1 point 2 and point 3 of the Act of August 29, 1997 on the protection of personal data (Journal of Laws No. 133, item 803, as amended)

4. The customer has the right to inspect their data, to correct them and to submit a request to stop their further use, and to liquidate the user’s account.

5. Correct completion of the registration form will activate the Customer’s account in the system.

6. The condition for the execution of the order is the correct conduct of the ordering process.

SUBJECTS OF THE TRANSACTION

1. The objects of transactions carried out via the website on the Internet are the products listed in the offer, services on the website of the online store www.shop.tco.com.pl at the time of placing the order.

2. The prices of all products in the store’s offer are equal to both net and gross value (including Polish VAT) in euros.

3. The products in the store’s offer are brand new and are attached to the manufacturer.

4. Products marked as “sale” are unused products, but their production data may be longer than 1 year.

5. Prices and availability of items marked as “Sale” and “Promotion” valid after confirmation by the Order Execution Department.

6. The store reserves the right to refuse to complete the order in any case of its implementation, in the event of unavailability of the ordered goods or due to other justified reasons.

ORDERS

1. The store’s customer can only be an adult, natural or legal person, regardless of whether they run a business or not.

2. Orders are accepted 24 hours a day, 7 days a week.

3. The order is constructed by the Customer on the basis of filling in a virtual basket.

4. After placing the order, the customer will receive an automatic return e-mail confirming the fact of placing the order and its specification. The order is accepted when the Customer Service Department of the TCO store sends the confirmation of the order acceptance status. Sending the status is also a confirmation of the conclusion of the sales contract between the Customer and TCO. Trading Company Sp. z o.o. and company – the owner of the shop. The subject of the contract is the goods listed in the status. Placing an order by the buyer means acceptance of the provisions of these regulations.

5. If the Customer chooses the Bank Transfer payment method, it is only after confirming the payment to the company’s account that the store will start shipping the ordered assortment.

6. In some cases, the store may contact the customer by phone to confirm the order or clarify ambiguities.

7. Orders with the selected form of payment “Bank transfer” or “Card payment”, from which the receipt of funds will not be recorded by the TCO store, may be canceled and the customer will be informed about it.

8. The TCO store reserves the right to fulfill incomplete orders in the event of shortages after prior notification to the customer. 9. The customer is notified as soon as possible about shortages of goods or any problems related to the execution of the order.

9. In the event of unavailability of some of the goods covered by the order, the Buyer is immediately informed about it. The buyer decides whether the order is to be partially fulfilled or canceled in full.

10. A limited number of goods is intended for promotional sales and sales. Orders are processed in the order in which confirmed orders are received, until the stocks covered by this form of sale are exhausted.

BASKET

1. Adding a selected product to the basket is not tantamount to its purchase.

2. The goods in the Customer’s basket until the end of the ordering process remain the sole property of the store.

FORMS OF PAYMENT

FORMS OF DELIVERY

1. The ordered goods will be delivered by a representative of the shipping company.

2. Shipping costs are covered by the ordering party. The shipping cost is given when placing the order.

3. Receipt of the parcel from the courier company must be confirmed with a written receipt. At the moment of receipt, the ownership of the goods and all risks associated with possession and use, in particular the risk of loss or damage, are transferred to the Buyer.

4. It is not possible to order the receipt of the goods with your own courier.

PROOF OF PURCHASE/ INVOICES

1. Together with the goods, a VAT invoice or a fiscal receipt is issued. If any of these documents are missing, please report this fact in order to complete the gaps.

2. Pursuant to the Regulation of the Minister of Finance of December 17, 2010 on sending invoices in electronic form, rules for their storage and the mode of making them available to the tax authority or tax inspection authority (Journal of Laws No. 249, item 1661), the Buyer accepts issuing and sending invoices in electronic form to the e-mail address provided during the registration of a new user. The moment of receipt of the invoice by the Buyer is considered to be the moment of opening the electronic correspondence with the attached invoice.

RETURNS

1. At the time of receipt of the goods, the Buyer is obliged to check the shipment. Any damage should be immediately reported to the employees present at the delivery or to the courier, and contact the Complaints Department of the TCO store by completing the complaint form, via e-mail to the address sklep@tco.com.pl. The basis for the complaint is the statement of damage in the form of a protocol written by the courier. If the Carrier refuses to sign the protocol, do not accept or acknowledge the shipment and immediately contact our Store.

2. Differences resulting from the individual settings of the customer’s computer (color, proportions, etc.) cannot be the basis for a complaint about the purchased goods.

3. Pursuant to the Act of March 2, 2002 on the protection of consumer rights (this act does not apply to business entities) goods purchased in our store using the “basket” can be canceled without giving a reason within 14 days from the date of receipt of the shipment (not applies to individual offers). However, only if the product is of full value, i.e. it has not been used or has not been damaged in any way. If you wish to return the goods, please inform the Complaints Department of the TCO store, which will provide information on the address for returning the goods (sklep@tco.com.pl). The goods should be provided with the received delivery note (WZ). The TCO store guarantees the return of the product value. The amount due will be refunded by bank transfer in the form of a transfer. Returns are not subject to the costs of returning the goods.

4. The return of the goods takes place only at the customer’s expense. 6. The customer undertakes that the goods returned by him are protected against possible damage during transport.

COMPLAINTS and WARRANTIES

1. All goods available in the store are covered by the manufacturer’s warranty, in accordance with point II sub-point 3 and 4 (light sources are not subject to complaints). We make sure that our goods are of the highest quality, but it may happen that after receiving the goods you discover some technical defects. In this case, please send a request by completing the complaint form, contact us by phone or e-mail (sklep@tco.com.pl) with the TCO store to discuss the method of exchange for a full-fledged product, exchange with the Customer’s consent for another one or, if this is not possible, refund. The cost of shipping a recognized complaint is borne by the TCO store, it should be sent back via a courier company.

FINAL PROVISIONS

1. Placing an order is tantamount to a declaration that the Customer has read the Regulations of the Store and fully accepts its terms.

2. We have made every effort to ensure that the information contained on the store’s website is true and up-to-date, but this information is not covered by any guarantee. There is only a small probability that the descriptions on the store’s website or photos (especially the colors of the products offered) may slightly differ from the reality.

3. The intended use of the products is only specified in their operating and application manuals. Under no circumstances will the TCO store be liable to any person for special, indirect or consequential damages incurred due to the use of the goods offered by us.

4. Responsibility for damages resulting from improper functioning of products used in accordance with their instruction manual is limited to the warranty conditions provided by the manufacturer, distributor or importer of a given product.
